In New Jersey, thousands of workers sustain work injuries and occupational illnesses that require them to undergo medical treatment and rehabilitation and to miss extensive time from work. Filing a Workers’ Comp Claim in NJ

An injured worker can pursue workers’ compensation benefits in New Jersey beginning by notifying their employer of their injury and workers’ comp claim. The state workers’ comp law requires employees to provide notice of a work injury, typically within 14 days of the date that the injury occurred. However, notice normally must be provided no later than 90 days after a work injury for an employee to be eligible for workers’ comp benefits.

Injured workers can give either oral or written notice of a work injury to a supervisor or manager, safety or HR department representative, or another authority figure in the company. Many employers do have written claims forms that injured workers can fill out to give notice of their workers’ comp claim.

An employer that is notified about an employee’s work injury or occupational illness must file a first report of injury with the New Jersey Division of Workers’ Compensation. The employer or its workers’ compensation insurer must also choose to either accept or deny the employee’s claim within 60 days. If an injured worker’s employer does not file a report with the Division of Workers’ Compensation or otherwise denies the worker’s claim or request for benefits, the worker must file a written claim petition with the Division. A claim petition allows an injured worker to request an informal hearing to try to resolve their dispute with their employer through mediation or to have a formal hearing before a workers’ compensation judge to obtain a binding ruling on their workers’ comp claim. A claim petition also allows an injured worker to obtain financial compensation for their permanent injury or disability.

Newark Workers’ Compensation Attorney

Newark is one of the hallmarks of New Jersey. Not only is it the most populated city, but its prime location at the mouth of the Passaic River has also made it the busiest seaport on the American East Coast. Newark also hosts the headquarters of several leading companies such as Prudential and PSEG. It is the location for the U.S District Court for the District of New Jersey and is also home to both Rutgers and Seton Hall Law schools.

Newark is also New Jersey’s largest employment center, with more than 100,000 people commuting into the city each day. Although there are many large financial, insurance, and technology companies with headquarters located in Newark it is still a large hub for blue-collar workers because of their airport, maritime port, and railways. Conveniently for those seeking to file official workers compensation complaints in Newark, the court where you would do so is right there. The Newark Workers’ Compensation Court is located at 124 Halsey Street, on the second floor and their telephone number is 973-648-2663.

With over 1,000 law firms scattered throughout the city, it will not be difficult finding an attorney willing to help you make your claim. However finding an attorney will be easy, finding the right attorney may be difficult. Many attorneys will listen to your claim and tell you they will help, but do not spend the time with you that you need. Time is of the utmost importance when it comes to workers’ compensation claims, as there are deadlines that need to be met in order to receive your full benefits. It would be incredibly unfortunate to lose out on compensation for your workplace injury because you did not pick the right attorney.

Frequently Asked Questions about Workers’ Compensation in Newark

How much does it cost to hire a workers’ compensation lawyer?

Can I collect additional compensation for my work injury outside of workers’ comp?

Can I be fired from my job while on workers’ comp?

Although it is illegal for an employer to terminate a worker in retaliation for filing for workers’ compensation benefits, an employer is still entitled to fire an at-will employee or to fire an employee according to the terms of their employment contract. An employer may even terminate an injured worker because their injury renders them unable to perform the essential functions of the employee’s job. However, terminating an employee on workers’ compensation does not end the employer’s obligation to continue providing workers’ comp benefits for a work injury or occupational illness the employee sustained while working for the employer.

Are workers’ compensation benefits considered taxable income?

Workers’ compensation benefits are generally not considered taxable income either under New Jersey state law or under federal tax law. However, there are limited circumstances under which benefits may be taxed, so it is important to speak with a Newark workers compensation lawyer about your individual situation.
