What Can You Get From Workers’ Compensation?

Filing a Workers’ Comp Claim After a Workplace Accident in Freehold, NJ

To file a workers’ compensation claim after being injured in an accident at work, you must first notify your employer of your work injury. Notice can be given orally or in writing, to a supervisor or manager or any other person in an authority position with your employer, such as an HR representative. State workers’ compensation law requires you to give notice of a work injury to your employer promptly, which normally means within 14 days of the date of your injury, to receive benefits from the date of injury. However, notice typically must be given no later than 90 days after a work injury to maintain eligibility for workers’ compensation.

When you give your employer notice of your work injury, your employer or its insurer is obligated to file a first report of injury with the New Jersey Division of Workers’ Compensation.  You must then file a written claim petition within two years of the date of your injury or last payment of benefits. A claim petition allows you to obtain an informal or formal hearing before a workers’ compensation judge to either try to resolve your claim with your employer or to obtain a binding ruling from the judge on your claim.  A claim petition also allows you to collect financial compensation for your permanent disability or injury.
