Pursuing Workers’ Compensation Benefits for Internal Injuries

The first and arguably most important step that any employee who suffers an injury at work must take is reporting the injury. This is because New Jersey has strict deadlines for when a workplace injury must be reported. Failing to report an injury in a timely manner can result in a waiver of the right to recover benefits. Pursuant to the law, an employee should notify his or her employer of an injury within 14 days of when it occurs. Employees who provide late notice may still be eligible to receive benefits under certain circumstances. If an employee does not notify an employer of a work-related injury within 90 days of the injury, however, and the employer has no independent knowledge of the injury, the employee cannot recover workers’ compensation benefits.

If an employee suffering from an internal injury complies with the New Jersey workers’ compensation notice requirements and sufficiently establishes that his or her injury is work-related, the employee may be able to recover both medical benefits and income benefits with the assistance of a New Jersey internal injury attorney. Medical benefits include the medical treatment needed to restore the employee to his or her pre-accident condition, as long as the treatment is reasonable. The employee may also be able to recover income benefits if he or she cannot work because of his or her injuries. Temporary total disability benefits are paid at a rate of 70% of the employee’s weekly wage but must fall within a state minimum and maximum. If the employee remains disabled past the temporary disability period, he or she may be eligible for either permanent partial disability benefits or permanent total disability benefits. The amount of permanent disability benefits that an employee receives and the duration for which they are paid depending on the nature and severity of the injury.
