Who Can Make a Claim for Workers’ Compensation Medical & Disability Benefits?
Under New Jersey’s Workers’ Compensation Law, most people who perform services for wages are covered. The law applies broadly: full-time employees, part-time workers, seasonal workers, and workers under age 18 can all be eligible. Immigration status doesn’t affect eligibility under New Jersey law.
Independent Contractor Classification
Independent contractors are excluded from coverage. Only employees can file a claim. When a dispute arises over whether a worker is an employee or an independent contractor, the burden falls on the employer to prove the worker isn’t an employee. A contract label alone isn’t conclusive; what matters is the actual nature of the working relationship.
Course & Scope of Employment
To recover benefits, the injury must be compensable. That means it must have occurred while the employee was performing job duties. Who Can Make a Claim for Workers’ Compensation Death Benefits?
When a work-related injury or illness causes a worker’s death, the deceased worker’s dependents are eligible to file a claim for death benefits under New Jersey’s Workers’ Compensation Law. Dependency is defined by statute, and the rules determine both who qualifies and whether they must prove their dependency or are presumed dependent by law.
Presumed vs. Actual Dependency
Some dependents are presumed by law and don’t need to prove their relationship: a spouse or natural children who lived with the worker at the time of death fall into this category. Dependent children generally remain eligible until age 18; full-time students remain eligible until age 23. A child who is mentally or physically disabled may qualify for additional benefits beyond those standard age cutoffs.
Other family members, including parents, siblings, grandparents, and grandchildren, must prove actual dependency to be eligible. A surviving spouse or natural children who didn’t share a residence with the worker at the time of death must also demonstrate actual dependency rather than relying on the presumption.
What Death Benefits Cover
Death benefits include funeral expenses up to $3,500 and 70% of the deceased worker’s average weekly wage, up to the maximum benefit amount established annually by the Commissioner of Labor. Because the weekly wage maximum is adjusted each year, we encourage surviving family members to confirm the current figures with our office. All benefits are divided among qualifying surviving dependents.
