Reopening a Workers' Compensation Claim

Reopening a Workers’ Compensation Claim in New Jersey

Support After a New Jersey Workplace Injury Worsens

An existing workers’ compensation award may no longer reflect the effects of your injury if your condition has deteriorated. Daniel Santarsiero NJ Workers' Compensation Lawyer helps injured workers determine whether a prior award may be reviewed and whether additional benefits may be available under New Jersey law.

We’ve served injured workers in New Jersey since 1993. Our involvement extends beyond the initial filing and award to complications involving delayed benefits, disputed treatment, claim denials, and interruptions in compensation. We explain each step in plain language and remain responsive as the case develops.

Call (934) 200-5372 to discuss your worsened condition and prior workers’ compensation award with our team.

When a New Jersey Workers’ Compensation Claim May Be Reopened

A reopener is an application to review or modify an earlier workers’ compensation award because incapacity connected to the original injury has increased. Under N.J.S.A. 34:15-27, an award, determination, rule for judgment, or order approving settlement may be reviewed when an injured worker’s incapacity subsequently increases.

The application generally must be made within two years of the date the injured worker last received a payment. Although that makes the payment history important, the prior resolution, current medical findings, and connection between the worsened condition and original workplace injury also require careful review.

Reopening isn’t a second claim for an unrelated condition. The worker must establish a causal relationship, meaning a medical connection between the greater incapacity and the injury or illness covered by the earlier award. We represent workers seeking benefits after occupational illnesses and workplace injuries, assessing the medical and procedural issues that affect a possible reopener.

How the New Jersey Reopener Filing Process Works

New Jersey uses Form WC-368, Application for Review or Modification of Formal Award, for a reopener petition. The application is filed with the New Jersey Division of Workers’ Compensation, which provides electronic filing through COURTS on-line for reopeners and amended reopeners.

The filing must accurately identify the prior case and the basis for requesting modification. An employer or insurance carrier may respond with Form WC-369, Answer to Application for Review or Modification of Formal Award. The response may dispute the alleged change, its connection to the original injury, or the requested benefits.

We help clients understand the filings and issues raised during the proceeding. Our team remains available for questions, provides consistent updates, and works to keep the case moving when medical treatment or benefits are disputed.
