Workplace Accident Lawyer in New Jersey
Workers’ Compensation Representation From First Claim Through Final Resolution
When a workplace accident disrupts your ability to work, the workers’ compensation system is supposed to cover your medical treatment and replace a portion of your lost wages. In practice, claims get denied, benefits get delayed, and insurers push back. Daniel Santarsiero NJ Workers' Compensation Lawyer has been representing injured workers throughout New Jersey since 1993, bringing more than 30 years of workers’ compensation experience to every claim we take on.
Daniel Santarsiero holds Certified Civil Trial Attorney status through the Supreme Court of New Jersey, a designation carried by a small fraction of New Jersey attorneys. That credential reflects a demonstrated capacity to litigate complex disputes before a judge, not just negotiate settlements. When an insurer delays, denies, or disputes your claim, we don’t redirect toward a quick resolution that falls short of the benefits you may be entitled to pursue.
If you’ve been hurt on the job anywhere in New Jersey, call (934) 200-5372 today for a free consultation. We’re available 24/7, offer virtual consults, and charge no fee unless we make a recovery on your behalf.
How We Approach Workplace Accident Claims
Most workplace accident claims don’t fall apart at the initial filing. They break down during denials, treatment disputes, and benefit interruptions that come weeks or months later. We stay engaged through the full lifecycle of a claim, not just the filing stage. Our team tracks deadlines, maintains disciplined documentation, and escalates formally when insurers use delay-and-deny tactics to minimize legitimate claims.
We advocate for the complete range of benefits New Jersey law allows: medical care, temporary total disability wage replacement, permanent partial or total disability awards, and long-term support where the injury warrants it. We also assess whether a third party other than your employer contributed to your accident, which may open a separate personal injury claim for damages like pain and suffering that workers’ compensation doesn’t cover.
Our team includes Spanish-speaking staff, multiple office locations across New Jersey, and virtual consult options. We communicate in plain language throughout the process, with consistent updates so you know where your claim stands.

Industries & Workers We Represent Across New Jersey
Workplace hazards look different depending on where you work. A construction worker facing a scaffolding fall needs different evidence and strategy than a warehouse worker with a repetitive stress injury or a healthcare worker hurt during patient transfer. We tailor our approach to the specific hazards, working conditions, and documentation demands of each industry.
We represent workers across construction, healthcare, transportation, logistics, public safety, manufacturing, and other industries throughout New Jersey. That includes construction workers, healthcare workers, law enforcement officers, firefighters, factory and plant workers, warehouse workers, highway and roadway workers, forklift and excavator operators, and transportation workers.
We also represent foreign-born employees, undocumented workers, and day laborers. Under New Jersey law, eligibility for workers’ compensation is based on employment and a work-related injury, not immigration status. Every covered worker has the right to file a claim, and we work to protect that right.
About New Jersey Worker's Compensation Lawyer
It is important to have a New Jersey workers compensation attorney review your claim as soon as possible to see that you are being treated fairly and to ensure that you receive full compensation for your injuries. Our injury attorneys do not charge a fee unless we make a recovery on your behalf.
Workers’ Compensation Benefits Available in New Jersey
New Jersey workers’ compensation provides several categories of benefits depending on the nature and severity of the injury. We advocate for the full range of what the law allows, not a minimal interpretation of what your claim “should” cover.
- Medical benefits: All reasonable and necessary treatment for the work-related injury or illness, including hospital stays, surgeries, prescriptions, and physical therapy, paid through an employer-authorized provider.
- Temporary total disability: Replaces approximately 70% of your average weekly wage while you’re unable to work, subject to annual state maximums and minimums.
- Permanent partial disability: Compensates for lasting functional loss based on injury type and severity, paid weekly after temporary disability benefits are exhausted.
- Permanent total disability: Applies when an injury prevents any gainful employment. Benefits are calculated at 70% of average weekly wages for an initial 450-week period and may continue beyond that period if total disability persists.
- Death benefits: Available to surviving dependents when a worker dies from a work-related injury or illness, covering a portion of wages and funeral expenses.
Workers’ compensation doesn’t cover pain and suffering or other non-economic losses. When a third party other than your employer caused or contributed to the accident, we assess whether a separate personal injury claim can recover those additional damages alongside your workers’ compensation benefits.
