Procedures That Can Shape a Workplace Injury Claim

Claims in Essex County are served by the Newark Workers’ Compensation Court. The applicable steps and deadlines depend on how the injury occurred, when an occupational illness was discovered, what benefits have been paid, and whether the employer or insurance carrier disputes the claim.

Notice & Authorized Medical Treatment

Notify your employer about a job-related injury as soon as possible and request treatment through the workers’ compensation carrier. The employer or carrier generally chooses the authorized treating physician, although exceptions may apply in an emergency or when proper treatment has been refused.

Benefits During Recovery

The system is generally no-fault, so eligibility doesn’t ordinarily depend on proving that the employer caused the accident. Medical benefits can cover authorized treatment, while temporary disability benefits generally require at least seven days of inability to work. Permanent disability benefits may apply when a compensable injury or illness causes lasting functional loss.

Disputed Claims & Filing Deadlines
